Acceptable Use Policy

1. Purpose

This Acceptable Use Policy ("AUP") defines the rules and conditions governing the use of the Optima Performance Science platform (the "Platform"). This AUP supplements and is incorporated by reference into our Terms of Service. By accessing or using the Platform, you agree to comply with this AUP. Violation of this AUP may result in suspension or termination of your account and access to the Platform, without refund.

2. Permitted Use

The Platform is provided for lawful purposes related to athletic performance analysis, injury prevention research, financial and career analytics for athletes, and related analytical activities. Permitted uses include:

• Submitting analytical queries and data for processing through the Platform's services.
• Uploading documents and files where a Service expressly supports uploads, subject to the applicable file and session limits.
• Reviewing, downloading, and using analytical outputs for your own internal decision-making, research, or professional purposes.
• Managing your account settings, preferences, and service history.
• Purchasing Service Bundles for personal or organizational use.

3. Prohibited Conduct

You shall not use the Platform to engage in any of the following activities:

3.1 Illegal and Harmful Activities

• Any activity that violates applicable local, state, national, or international law or regulation.
• Submitting, uploading, or transmitting content that is unlawful, defamatory, obscene, threatening, harassing, or that promotes violence or discrimination.
• Using analytical outputs to facilitate illegal gambling, match-fixing, insider trading, or any form of sports corruption.
• Submitting personally identifiable information of third parties without their consent for analytical processing.
• Using the Platform to stalk, harass, or harm any individual.

3.2 System Abuse

• Attempting to gain unauthorized access to the Platform, other user accounts, or systems connected to the Platform.
• Circumventing, disabling, or interfering with security features, authentication mechanisms, or access controls.
• Introducing malware, viruses, worms, trojan horses, or other harmful code into the Platform.
• Conducting denial-of-service attacks, port scanning, or other network-level attacks against the Platform infrastructure.
• Using automated tools (bots, scrapers, crawlers) to access the Platform or extract data without prior written authorization.
• Attempting to reverse engineer, decompile, or disassemble any part of the Platform software.

3.3 Service Abuse

• Creating multiple accounts to circumvent usage limits, bans, or pricing structures.
• Sharing account credentials with unauthorized individuals.
• Reselling, sublicensing, or commercially redistributing Platform services or analytical outputs without authorization.
• Submitting intentionally misleading, fraudulent, or fabricated data to the analytical services.
• Exploiting errors, bugs, or vulnerabilities in the Platform for personal gain or to disrupt service for other users.
• Using the Platform in a manner that disproportionately burdens infrastructure or degrades service quality for other users.

3.4 Intellectual Property Violations

• Uploading content that infringes on the intellectual property rights of any third party, including copyrighted materials, trademarks, or trade secrets.
• Using the Platform to generate content that infringes on the intellectual property rights of others.
• Removing, altering, or obscuring any proprietary notices, labels, or marks on the Platform or its outputs.

4. Data Upload Guidelines

When uploading files or data to the Platform, you must ensure that:

• You have the legal right to upload and process the data.
• The data does not contain malicious code, executable files, or content designed to exploit system vulnerabilities.
• Sensitive personal data (health records, financial account numbers, government identification numbers) is uploaded only when necessary for the analytical purpose and in compliance with applicable data protection laws.
• You comply with the file upload limits stated for the applicable Service.
• File sizes comply with the Platform's stated limits.

5. Monitoring and Enforcement

The Company reserves the right, but is not obligated, to monitor use of the Platform for compliance with this AUP. If we determine, in our sole discretion, that a violation of this AUP has occurred, we may take one or more of the following actions:

• Issue a warning to the account holder.
• Temporarily suspend access to the Platform or specific features.
• Permanently terminate the account without refund of any prepaid Service Bundle credits.
• Remove or disable access to content that violates this AUP.
• Report the activity to law enforcement authorities where required or appropriate.
• Pursue legal remedies, including claims for damages and injunctive relief.

The Company will make reasonable efforts to notify users of enforcement actions, except where notification would compromise an investigation, endanger safety, or violate legal obligations.

6. Reporting Violations

If you become aware of any use of the Platform that violates this AUP, please report it through our Contact page. Include as much detail as possible, including the nature of the violation, the user or content involved, and any supporting evidence. We will investigate all credible reports and take appropriate action.

7. Changes to This Policy

We may update this Acceptable Use Policy from time to time. When material changes are made, we will update the "Effective Date" at the top of this document. Your continued use of the Platform after the posting of changes constitutes your acceptance of the updated AUP. We encourage you to review this policy periodically.
